Landlord tried to keep my $1,200 deposit over "pet stains" and I got it all back in 9 days
I moved out of my place in Austin last month after 2 years and the landlord said my cat damaged the carpet, so he kept the whole $1,200 deposit. I had taken pics on move in day and move out day, and the carpet looked the same in both sets. I sent him a letter with the photos and cited the Texas rule that says he has 30 days to give an itemized list, which he never did. Nine days later the full check showed up with no note. Has anyone else had to push back on a deposit like this, and did photos end up being enough proof?
Did the photos really do all the work, or was it the missing itemized list? In Texas your landlord has 30 days to send you a written list of what he kept and why, and if he skips that step he usually loses the right to keep any of it. So you probably won because he broke that rule, not because the carpet pics proved your case.
