DAE notice that 3 person tents are being sold as 2 person tents now?

I was at a campground near Estes Park over the weekend and a family next to us had a 3 person tent that was packed to the gills with just 2 sleeping bags. I asked the dad about it and he said the company's website listed it as a 2 person tent for 'comfort'. Three years ago I bought a 2 person tent from the same brand and it fit me and my dog with room for our packs. Now I'm seeing this on almost every gear site I check. Has anyone else run into this sizing problem, and do you just size up now or look for older models?
