Showerthought: I thought those $20 application fee refunds were a scam, then I got one back in Denver
Last spring I applied to a place in Denver and the landlord said the $20 fee was non refundable, which I figured was just how it goes. Turns out Colorado caps fees and makes them refundable if they run your report and pick someone else, so I emailed a polite note with the statute and got my $20 back in 9 days. Has anyone else actually gotten money back from a landlord like this, or did I just get lucky with this one?
The part about the landlord saying the fee was non refundable is what gets me. In Colorado that law has been on the books for years, so either he didn't know or he was hoping you wouldn't push back. Did you have to send a second email before he paid up, or did the first one do it? I'm curious if he argued at all or just cut the check once he saw the statute cited.
